Meter is out of service or registers inaccurate ly, the measurement of the Meter shall be determined by the following

alternatives, in the following order: () any alternative or back-up meter that Seller may have installed, if registering accurately; ()

mathematical calcu lation if upon calibration test of such Meter percentage error is ascertainable; or () estimates of deliveries of

Net Facility Output or fuel by refe rence to quantities measured during periods of similar conditions when such Meter was registering accurately. Section 1.4 Calibration . Seller shall provide calibration testing of the Meter, by an independent third party consultant retained by the Seller, at least annually to ensure the accuracy of such Meter. Buyer may request that Seller perform more freque nt testing; any such testing in excess of the minimum once-per-year tests shall be at Buyers expense. Buyer shall be entitled to witness all such calibration tests. Section 1.4.1 If upon testing, any Meter is found to be accurate or in error by not more than plus or minus one quarter of one perc ent (.2%) for electricity meters and three-tenths of one percent (0.3%) for gas mete rs, then previous recordings of such Meter shall be considered accurate in computing deliveries of Net Facil ity Output or Delivered Fuel Quantity, as applicable, hereunder, but such Meter shall be promptly adjusted to record correctly. Section 1.4.2 If, upon testing, any Meter shall be found to be inaccurate by an amount exceeding plus or minus one quarter of one percent (.2%) for electricity meters and three-tenths of one percent (0.3%) for gas meters, then such Meter shall be promptly adjusted to record properly and any previous recordings by such Meter shall be corrected to zero error as set forth.
