If the software has been modified or individually developed by Flender, Flender shall in addition provide the Cust omer with workaround or other inter im erro correcting solution until the prov ision of an updated version of the software in which the defect is remedied, if such workaround or interim solutio is feasible at reasonable expense and if other wise the Customers business operatio ns would be stopped or substantiall impede . 1.6 If Flender re-performs allegedly defective Servic es and it is ultimately not established that th Services were defective, th Customer shall pay Flender for such re -perfo rmanc . 1.7 Any other liability of Flender and laims of the Cust omer in ase of defective Servic es or defects, other than those expressl stipul ated in this Clause 1 or, in case Flender failed at least three imes in emedying/re -performing, Clause 1 6.2 ), sha ll be excluded.
